1. ACCEPTANCE. We may revise this Agreement from time to time. You should periodically check the Agreement on our web site www.abdh.net for the most current version of this Agreement. Each time You use the Affordable Business Domain Hosting Internet Service will constitute renewed confirmation that You agree to the terms and conditions contained in the Agreement and Your acceptance of all changes We make to the Agreement.

2. REGISTRATION. You must be at least eighteen (18) years of age to register for the Affordable Business Domain Hosting Internet Service and You must use Your own name when registering. By registering You agree to promptly defend, indemnify and hold Affordable Business Domain Hosting and its officers, employees and agents harmless from all claims, damages, losses, liabilities and expenses arising out of or in any way connected with use of the Affordable Business Domain Hosting Internet Service by You or others who use Your password and account.

3. CHARGES. You are responsible for keeping all billing data which You have provided to Us accurate and up to date. We may terminate Your account if You provide Us with false, inaccurate or obsolete data. If You fail to pay any charges when due, if a charge against Your credit card is rejected or reversed or if Your check is returned or otherwise not honored by Your bank, We may terminate Your account without notice to You.  We may bill You an additional charge to reactivate Your account.

4. PASSWORDS. You will receive a username and password when You register for Affordable Business Domain Hosting Internet Service. Only one person using Your password may be logged on to the Affordable Business Domain Hosting Internet Service at any time, unless other wise bought or agreed upon. Affordable Business Domain Hosting may terminate the session and/or Your account in the event more than one person using Your password logs on to the Affordable Business Domain Hosting Internet Service at one time. You are responsible for maintaining the confidentiality of the password for Your account. You acknowledge that (a) You are responsible for all activities that occur under Your password or account and (b) Affordable Business Domain Hosting is not and will not be liable for all loss or damage arising from any failure to maintain the confidentiality of Your password.

5. CONDUCT. You agree that You will not, sell or resell Affordable Business Domain Hosting Internet Service to any other person, business or other entity, unless you are a specified and authorized reseller of our services.  You also agree You will not permit others to use Your Affordable Business Domain Hosting Internet Service account to (a) transmit or receive any Data that is unlawful, harmful, threatening, defamatory or vulgar or that invades the privacy of others or that is otherwise objectionable, (b) transmit or receive any Data that contains a virus, Trojan horse, bot, time bomb, worm or any other harmful or undesirable code or program, (c) attempt to gain unauthorized access to any computer system or network by any means, (d) interfere with any other person's use and enjoyment of the Internet, (e) attempt to intercept or view private communications not intended for You, or (f) violate any applicable laws or regulations.

6. YOUR EQUIPMENT AND TELEPHONE LINES. In order to access and use the Affordable Business Domain Hosting Internet Service, You must provide, at Your expense, all input/output devices, such as modems, computers and software, and communication services, such as long distance and local telephone services, which are necessary to obtain and maintain a connection to Affordable Business Domain Hosting's servers and equipment.

7. SUPPORT. If You experience problems with Your Affordable Business Domain Hosting Internet Service You may contact Affordable Business Domain Hosting by telephone or e-mail. In addition, Affordable Business Domain Hosting maintains a staff of customer service representatives who will be available to receive Your calls. Whether You contact Affordable Business Domain Hosting by telephone, voice mail or e-mail, we will use commercially reasonable efforts to respond to You within 24-48 hours.

8. DISCLAIMER OF WARRANTIES. EXCEPT WHERE PROHIBITED BY LAW, Affordable Business Domain Hosting MAKES NO EXPRESS OR IMPLIED WARRANTIES (INCLUDING WARRANTIES OF TITLE, NON-INFRINGEMENT, AND IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) AND DOES NOT WARRANT THAT THE INTERNET SERVICE PROVIDED BY Affordable Business Domain Hosting WILL BE SECURE, UNINTERRUPTED OR ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED. THE SERVICE IS PROVIDED ON AN "AS IS" BASIS. SOME STATES DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES THEREFORE, SOME OF THE LIMITATIONS CONTAINED IN SECTION 8 MAY NOT APPLY TO YOU.

9. LIMITATION OF LIABILITY. YOU AGREE THAT Affordable Business Domain Hosting SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES RESULTING FROM: (a) THE USE OR THE INABILITY TO USE THE Affordable Business Domain Hosting INTERNET SERVICE; (b) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; OR (c) ANY OTHER MATTER RELATING TO THE Affordable Business Domain Hosting INTERNET SERVICE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS OF SECTION 9 MAY NOT APPLY TO YOU.

10. TERMINATION. You may cancel Your account at any time if You notify us in advance. You agree that (a) Affordable Business Domain Hosting, in its sole discretion, may terminate Your password and account at any time, with or without notice to You, (b) when Your account is terminated or canceled, either by You or by Us, without regard to the reason for the termination, Affordable Business Domain Hosting may remove and discard any Data that You have stored on Affordable Business Domain Hosting servers, hard drives or other equipment or hardware and (c) Affordable Business Domain Hosting shall not be liable to You or any third party for any termination or cancellation of Your account or for removing or discarding Data. If You have not breached any term of this Agreement and We cancel Your account, we will refund to You a prorated portion of any charges You have paid for service after the cancellation date, at our sole discretion.
