Illegality in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted software, violation of U.S. export restrictions, harassment, fraud, trafficking in obscene material, drug dealing, and other illegal activities. Websites which have illegal Adult Material of any sort are strictly prohibited. We define "adult material" as illegal pornography, nudity and sex-related merchandising. Because of increased controversy surrounding Emulators/ROMs, we do not allow any websites pertaining to Emulators/ROMs. These issues usually have to do with copyright violations and we prohibit any websites distributing Emulators or ROMs. Websites whose primary purpose is file distribution or mirroring another website. Illegal MP3 files are strictly forbidden from our servers. There are no exceptions made to this rule as it exists to protect ourselves from any copyright infringement problems.

Net abuse, including but not limited to activities such as using a non-existent e-mail return address on a commercial solicitation, spamming (sending unsolicited advertising to numerous e-mail addresses or newsgroups and/or generating a significantly higher volume of outgoing e-mail than a normal user), allowing spamming by third parties to promote a web site hosted by ABDH, trolling (posting outrageous messages to generate numerous responses), mail bombing (sending multiple messages without significant new content to the same user), subscribing someone else to a mailing list without that person's permission, cross-posting articles to an excessive number of newsgroups, or attempting without authorization to enter into a secured computer system. ABDH reserves the right to determine what constitutes net abuse. Any processes executed which run in the background from the command line, including IRC Bots, EXE's and CGI scripts. Links to illegal adult websites, illegal MP3 sites, warez sites, or hacking websites.

Tortuous conduct, including but not limited to posting of defamatory, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights.

Security
Violations of system or network security are prohibited and may result in criminal and civil liability. Examples include but are not limited to the following: unauthorized access, command line abuse, use, probing, or scanning of systems security or authentication measures, data, or traffic; interference with service to any user, host, or network including, without limitation, mail bombing, DoS, flooding, deliberate attempts to overload a system, broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting. Any attempts to undermine or cause harm to a ABDH.Net's servers, network or customers are strictly prohibited.

* Misuse of system resources, including but not limited to employing posts or programs which consume excessive CPU time, storage space or attempt to undermine a servers' security; permitting use of mail services, mail forwarding capabilities, POP3 accounts, or auto responders other than for the customer's own account; resale of access to CGI scripts installed on ABDH's servers; or attempting to use a single customer account for third party web sites by allowing more than one domain pointer to be used to reference pages within the customer's site. Complaints about violators of our policies should be referred to abuse@abdh.net. Each complaint will be investigated. Sending unsolicited e-mail, or "Spam" through our mail servers. This includes promoting a website hosted with us through unsolicited e-mail, regardless of whether or not the unsolicited e-mail is sent through our mail servers or not. With the growing popularity of CGI scripts, problems arise with CGI scripts which consume too much CPU run time and/or RAM. This is true regardless of the amount of system resources. While CGI scripts can create dynamic features on your website, they can also have a detrimental effect on system performance. Poorly written CGI scripts can have infinite loops or other problems which causes them to run non-stop or use as much RAM as possible. It is important that you obtain CGI scripts from these popular free CGI script archives with care. Make sure your code is efficient and operates normally. We will have no problem with any free CGI scripts obtained from archives that have a good reputation, such as CGI World, Matt's Script Archives, or CGI-Resources.

We cannot speak for any other free archives. It is your responsibility to ensure all CGI scripts operate efficiently, so be careful of what free CGI scripts you run on your site! Under circumstances where a script is using as much of the CPU and RAM available, we will disable the program to prevent this from having an adverse effect on the server. If these incidences continue, we will be forced to terminate your account. Additionally, the following types of CGI scripts are prohibited:

1. CGI scripts which upload files from the web to your account. These scripts can be potential security problems.
2. CGI scripts which serve a chartroom applications because they are system resource problems, having to refresh every few seconds for each client in the chartroom.

Copyright Material, Materials distributed on your website cannot infringe upon another groups copyrights. This especially includes distributing copyright software, or "warez", also know as pirated software, illegal MP3 files which usually consist of copyrighted music, and Emulators/ROMs. Please ensure that your website consists of your own work and none of the contents on your website do not infringe upon anyone else's copyrights.

The best policy is good judgment. Do not copy anyone else's images unless free of copyrights, distribute illegal MP3 files or pirated software.

- Websites found in violation of this policy are subject to account termination without notice and any refunds are void.
- Violations of system or network security are prohibited and may result in criminal and civil liability.

Actions Taken by Affordable Business Domain Hosting.
The failure by a customer to meet or follow any of the above Terms of Use may result in account termination. ABDH.Net will be the sole arbiter as to what constitutes a violation of the Terms of Use. ABDH.Net reserves the right to terminate any account without prior notice.

When ABDH.Net becomes aware of an alleged violation of its Terms of Use, ABDH.Net will initiate an investigation. During the investigation, ABDH.Net may restrict a customer's access in order to prevent further potentially unauthorized activity. Depending on the severity of the violation, ABDH.Net may, at its sole discretion, restrict, suspend, or terminate a customer's web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, ABDH.Net will notify the appropriate law enforcement authorities of such violation. ABDH.Net does not issue credits for outages incurred through service disablement resulting from Terms of Use violations.

ABDH.Net customers agree to indemnify and hold harmless ABDH.Net from any claims resulting from the use of our services that damages them or any other party. The ABDH.Net service is provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. ABDH.Net expressly disclaims any representation or warranty that the ABDH.Net service will be error-free, secure or uninterrupted.  No oral advice or written information given by ABDH.Net, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice.  ABDH.Net and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.
